Although DMV hearings are difficult to win, we have won them. When we win, it is based on the merits of the case, not because the officer does not show up for the hearing.

DUIs are very technical, and there is a rigid format that must be followed before the intoxilyzer test can be used against you. To win a DMV hearing, we examine the steps that led to the DUI arrest to determine if your rights were violated. Possible weaknesses in a case can include:

- No probable cause to ask you to exit the vehicle
- No probable cause to require you to complete the Field Sobriety Tests

We get to know the law enforcement officer testifying against you and size up the other side to determine what we will be up against at trial.
In addition, we can get the officer's testimony committed to the audio record to use against him at trial if necessary. This allows us to impeach the officer to attack his memory and/or credibility if his story changes at trial.
